Edo Speaker, Clerk to appear before A-Court over alleged contempt


  The Court of Appeal sitting in Benin, Edo State, has ordered Mr. Victor Edoror, Speaker of the Edo State House of Assembly, and Barr. Lawson Ugiagbe, Clerk of the House, to swear in Mr. Sylvanus Eruaga, the Peoples Democratic Party (PDP) member representing Etsako West constituency 2, or risk being committed to prison for contempt of court.

Hon. Victor Edoror and Lawson Ugiagbe were summoned on Monday to explain why he should not be jailed for Contempt of court.

 Also, ordered to appear before the court is the clerk of the house, Barr Lawson Ugiagbe.

Both the Speaker and the clerk of the house are expected to face the court on appearance, following the alleged refusal of the duo to comply with an earlier order of the court on form 48 which is notice of consequence of disobedience of court order in the suit CAC/B/EPT/343/2015 between Gallant Commander Sylvanus Eruaga and Dr Gowon Yakubu Marughu, INEC, REC Edo state, APC and others.

Similarly, the Appeal Court had last week issued form 49 which is notice to show cause why an order of committal to prison should not be made on the two (Speaker and Clerk) in suit CA/B/93/2016.

The order, read: "Take notice that the judgment creditor/applicant will on March 21, 2016, at 9a.m., apply to this court for an order for your committal to prison, for having disobeyed the order of this court made on December 19, 2015 requiring you to swear in the judgment creditor/applicant as the member to represent Etsako West constituency in the Edo State House of Assembly and despite the service of form 48 (notice of consequence of disobedience of court order) on you on March 5, 2016."

Contacted on phone by newsmen, the speaker, Mr Edoror said: "I am not aware of that. I need to confirm what you have said."
