The Supreme Court failed on Tuesday, July 30, to hear the application filed by the Peoples Democratic Party (PDP) and its presidential candidate in the 2019 election.
        According to reports, the appeal was stalled because of alleged late filing of the application by the PDP and Atiku against the presidential election petition tribunal. The Nation reports that the appeal was against a ruling of the tribunal, which held that Atiku and the PDP do not have a reply to an application filed on May 14, 2019. by the All Progressives Congress (APC), which included that they cannot access the central server of the Independent National Electoral Commission (INEC). The application, which was filed by the APC, sought, among others, the dismissal of the case brought by Atiku and the PDP challenging President Muhammadu Buhari’s victory at the election. It was learnt that when the appeal with number SC/738/2019 was mentioned, the lead lawyer to the appellants, Paul Erokoro, a senior lawyer, said he regretted just filing the fresh application, which is for leave to bring supplementary records from the lower court. Also, the lawyers to INEC, Buhari and the APC told the court that they were just served with the application and needed time to examine it and react appropriately. The five-man panel of the court, led by Justice Mary Peter-Odili, adjourned till August 20, 2019 for hearing.
