Appeal court declares wike as duly elected gov of rivers state, throws out petition

An election case brought against Governor Nyesom Wike of Rivers was, on Monday, December 2, thrown out by an appeal court sitting in Port Harcourt, capital of the state.
The appellate court ruled that the petition brought by the candidate of the Action Democratic Party (ADP), Victor Fingesi, lacked merit. His petition was earlier dismissed by the governorship tribunal. He, however, headed to the appeal court. In the judgement led by Justice HN Ogunwimiji, the appeal court said Fingesi could not prove the allegation of irregularities during the election. The appeal court further ruled that the Independent National Electoral Commission (INEC) has the constitutional backing to carry out its activities. The court declared that Fingesi was not qualified to petition the election tribunal against Wike. The decision was unanimously agreed to by Justice TN Orji Ababua, Justice U Omyenenn, Justice HA Barka and Justice IB Idiris. Wike's counsel, Ike Udenna, reacted to the decision of the appeal court in favour of the governor as he said the case was thrown out for lacking merit.
